1. Introduction

1.1 This agreement outlines the terms and conditions for renting an E-Bike, Scooter, or Motorcycle from Nibble Bikes. By renting an E-Bike, Scooter, or Motorcycle, you agree to comply with these terms, including all associated fees as outlined in the Fee Chart.

1.2 Rental Contract: Your contract to hire an E-Bike, Scooter, or Motorcycle (Rental Contract) comprises:(a) The Rental Agreement you have signed to rent the E-Bike, Scooter, or Motorcycle from Us; and(b) These Terms and Conditions of Rental, which include the Direct Debit Service Agreement (clauses 2.5, 6.7, 6.8, 6.10, 6.11, 15.1).These documents create binding and enforceable legal obligations, and your signature on the Rental Agreement confirms your acceptance of these obligations. The Handover Inspection Report, including photos, is provided alongside these Terms and Conditions at the Start of the Rental to document the vehicle’s condition.

1.3 Permitted Use: The Rental Contract permits use of the E-Bike, Scooter, or Motorcycle for private and some commercial purposes, including food delivery.

1.4 Electronic Signatures: We may use electronic signatures as a means of entry into the Rental Contract. When you insert an electronic signature, you consent to the use of this means of acknowledgment and acceptance of these Terms and Conditions and your obligations under the Rental Contract.

1.5 Amending Terms and Conditions: We may amend these Terms and Conditions by providing you with 30 days’ notice in writing. If you do not accept the amendments, you must return the E-Bike, Scooter, or Motorcycle prior to the end of the 30-day period.

2. Rider Eligibility

2.1 You must hold a valid Australian or overseas driver’s license, with a motorcycle endorsement for vehicles over 50cc. A learner’s permit is not accepted.

2.2 You must be at least 18 and not over 75 years of age and have at least 12 months’ riding experience, unless we have agreed to a variation of these restrictions before the Start of the Rental, as noted in the Rental Agreement.

2.3 Nibble Bikes may assess your riding skills, but any opinion formed is subjective. You agree that lack of riding skills cannot be used to claim Nibble Bikes should not have permitted the rental or to avoid liability for payments due. A breach of this clause constitutes a Major Breach of the Rental Contract.

2.4 Only you or an Authorised Rider may operate the E-Bike, Scooter, or Motorcycle. Allowing an unauthorized person to ride constitutes a Major Breach of the Rental Contract.

2.5 Safety Induction: Safety is our principal concern. If, in our sole opinion, you do not have the skill or competence to ride the E-Bike, Scooter, or Motorcycle safely, we may decline the rental, and any prepaid charges will be refunded in full. At the Start of the Rental, we will conduct a short induction to ensure you are familiar with the handling and controls of the E-Bike, Scooter, or Motorcycle, which may include a short test ride to confirm your competence.

2.6 Overseas License Address Requirement: If you hold an overseas or international driver’s license, the identification provided must include your overseas home address to enable Nibble Bikes to send correspondence if you leave Australia. If your driver’s license does not include your overseas home address, you must provide additional proof of address, such as a National ID Card (e.g., Carte Nationale d’Identité, Personalausweis), utility bill, or government-issued document showing your name and overseas residential address. Failure to provide this may result in the rental being declined.

3. Rental Agreement

3.1 You must provide valid identification, a credit/debit card, and any required licenses before renting an E-Bike, Scooter, or Motorcycle. If you hold an overseas or international driver’s license, you must also comply with the address requirements in clause 2.6, which may include providing a valid passport or other proof of your overseas home address.

3.2 You must inspect the E-Bike, Scooter, or Motorcycle at the Start of the Rental and note any pre-existing damage in the Handover Inspection Report provided alongside these Terms and Conditions.

3.3 The E-Bike, Scooter, or Motorcycle must be returned to the Rental Location during standard business hours, in the same condition as at the Start of the Rental, subject to fair wear and tear.

3.4 A minimum rental period of two weeks applies, after which you may swap or return the E-Bike, Scooter, or Motorcycle during standard business hours, subject to availability. Our preference is to keep a rider using the same vehicle; however, we will accommodate a swap if both parties agree.

4. Vehicle Use

4.1 You must ride the E-Bike, Scooter, or Motorcycle in accordance with local laws and regulations, including speed limits and bike lane usage where applicable.

4.2 The E-Bike, Scooter, or Motorcycle must not be used for illegal activities, racing, or carrying excessive weight (e.g., exceeding 110kg for E-Bikes).

4.3 The E-Bike, Scooter, or Motorcycle must not be used in prohibited areas, including:

4.4 The E-Bike, Scooter, or Motorcycle must not be ridden outside a 30km radius from the Rental Location without prior written permission from Nibble Bikes, noted in the Rental Agreement. A breach of this clause constitutes a Major Breach of the Rental Contract.

4.5 The E-Bike, Scooter, or Motorcycle must not be ridden by you or any Authorised Rider:

5. Fees and Deposits

5.1 All fees are outlined in the Fee Chart below.

5.2 Dishonored Payments: If a payment authorized under the Direct Debit Service Agreement within these Terms and Conditions is dishonored, fees will apply as per the Fee Chart (clause 5.7(c)).

5.3 Fines and Infringements: You are responsible for all fines or infringement notices issued during the Rental Period, including a processing fee (clause 5.6).

5.4 Security Deposit: A refundable Security Deposit, based on the customer’s selected plan (Shield, Glide, or Boost) as outlined in the Fee Chart, is required at the Start of the Rental, refunded within 10 days after verifying:

5.5 Fees may be charged post-rental for fines or damages identified after vehicle return.

5.6 Fine Processing: A Fine Processing Fee applies for each fine or infringement notice received, including post-return. If we pay any fines or infringements on your behalf, we will charge you the fine amount plus the Fine Processing Fee.

5.7 Payment Failures: If a toll payment authorized under the Direct Debit Service Agreement within these Terms and Conditions is dishonored, an Invoice Fee applies (clause 5.7(c)). The Scooter or Motorcycle is registered with Linkt for toll roads, and charges will be debited weekly from your card on file or provided bank account, whichever is relevant, including a merchant fee (1.75%) plus 30 cents per transaction.

5.8 You authorize Nibble Bikes to debit any fees or charges incurred during or after the Rental Period from either the card on file or provided bank account, whichever is relevant, as per the Direct Debit Service Agreement within these Terms and Conditions. Nibble Bikes will provide an invoice for all fees and charges, and if payment is not received by the due date specified in the invoice, Nibble Bikes may process the payment using the card or bank account details on file at any time.

5.9 A breach of clause 5.7 constitutes a Major Breach of the Rental Contract.

5.10 Rental Charges: All Rental Charges must be paid weekly, no less than seven days in advance, via the Direct Debit Service Agreement within these Terms and Conditions, until the E-Bike, Scooter, or Motorcycle is returned.

5.11 Default in Payment: If you default in payment of any moneys owed under the Rental Contract:

5.12 Unlimited Kilometers: Unlimited kilometers are included with all rentals at no additional cost, provided the E-Bike, Scooter, or Motorcycle is used within the 30km radius from the Rental Location as per clause 4.4.

6. Vehicle Condition

6.1 You must return the E-Bike, Scooter, or Motorcycle in a clean condition, with a full fuel tank (for Scooters or Motorcycles).

6.2 A Cleaning Fee or Fuel Fee may apply if the E-Bike, Scooter, or Motorcycle is returned in poor condition (beyond fair wear and tear).

6.3 At the End of the Rental, you must present the E-Bike, Scooter, or Motorcycle to us for inspection. We will conduct a full inspection and compare any damages found with the initial photos taken at pickup. If new damages are found, we will provide a detailed quote. Your repayments stop when the E-Bike, Scooter, or Motorcycle is returned.

6.4 Any amount payable at the End of the Rental is subject to subsequent verification and adjustment. Details of adjustments will be provided as soon as practicable. If any amount remains unpaid, you authorize us to debit it from the card on file or provided bank account, whichever is relevant. Overdue amounts accrue interest at 10% per annum starting 14 days after the End of the Rental.

7. Accessories

7.1 A helmet, phone holder, and delivery bag are included with all rentals at no additional cost and must be returned in good condition. Other accessories (e.g., jackets, goggles, gloves, security lock) may be hired at extra cost as outlined in the Fee Chart.

7.2 A fee applies for lost or damaged accessories, as outlined in the Fee Chart (clause 7.2).

8. Maintenance and Servicing

8.1 You must report any mechanical issues immediately to Nibble Bikes via the Rider Hub on nibblebikes.com.au. You must not ride the E-Bike, Scooter, or Motorcycle unless authorized by us, and no one else may repair, work on, tow, or salvage the E-Bike, Scooter, or Motorcycle without our prior written authority.

8.2 If a service is overdue by more than 300km, a Late Service Fee applies (clause 8.2). A failure to have the E-Bike, Scooter, or Motorcycle serviced when it reaches the kilometer limit shown on the sticker under the seat constitutes a Major Breach of the Rental Contract, meaning you are responsible for all Damage.

8.3 You must not attempt repairs or modifications to the E-Bike, Scooter, or Motorcycle.

8.4 Nibble Bikes provides complimentary servicing and maintenance, included in the subscription price. A service sticker under the seat indicates the next service due date and includes a QR code to book a service. You must maintain engine oil and tyre pressures, checking them at least weekly.

9. Damage, Theft, and Claims

9.1 You are responsible for any damage or theft of the E-Bike, Scooter, or Motorcycle during the Rental Period, subject to the applicable Excess Fee (clauses 9.2, 12.7). If you are at fault, you are also responsible for the cost of repairs or replacement of damages caused to third-party vehicles or property, which must be resolved directly with the third party. Nibble Bikes does not cover or manage third-party claims (see clause 11.1), and you may need your own insurance policy to cover such liabilities.

9.2 An Excess Fee applies for each claim involving damage or theft, including theft due to an unattended vehicle post-accident/breakdown, as per the Fee Chart (clauses 9.1, 9.2, 12.7).

9.3 In the event of an Accident or theft, you must report it to Nibble Bikes within 24 hours via the Rider Hub on nibblebikes.com.au, by phone, or by email, and complete an Accident/Theft report form. It is your responsibility to bring the E-Bike, Scooter, or Motorcycle to the Rental Location for an inspection/quote within 24 hours of the Accident, or contact us to arrange towing if the vehicle is unrideable.

9.4 Failure to report or bring the vehicle for inspection may result in additional fees or liability.

9.5 A breach of clause 9.3 constitutes a Major Breach of the Rental Contract.

9.6 You must cooperate with us in investigating any Accident or theft claim, including attending our lawyer’s office or court hearings if required.

9.7 You will have to pay the Excess Fee for a claim regardless of who is at fault, as Nibble Bikes does not manage third-party claims (see clause 11.1). If a third party covers the damage costs, we will release the Security Deposit.

9.8 In the event that a stolen E-Bike, Scooter, or Motorcycle is recovered, Nibble Bikes will calculate any loss of revenue (as per the Loss of Use definition), recovery costs, and damages. Any Excess Fee paid will be refunded after deducting these charges, with details provided in an invoice.

10. Roadside Assistance

10.1 If the E-Bike, Scooter, or Motorcycle breaks down during the Rental Period, you must notify Nibble Bikes via the Rider Hub on nibblebikes.com.au. We will recover and repair the E-Bike, Scooter, or Motorcycle as soon as possible or provide a replacement where available. We provide internal roadside assistance between 10 AM and 10 PM, 7 days a week, with attendance within 4 hours and an average response time of 1 hour.

10.2 A Roadside Call-out Fee applies for non-mechanical/manufacturer fault breakdowns, as per the Fee Chart.

10.3 If a Nibble Bikes driver is unavailable, you must ensure the E-Bike, Scooter, or Motorcycle is placed in a secure location and take all reasonable steps to reduce the risk of loss or theft. Nibble Bikes guarantees a 24-hour turnaround for roadside assistance but is not responsible for damage or theft within this timeframe.

11. Insurance Coverage

11.1 Nibble Bikes does not provide third-party accident cover for property damage or other liabilities. You are responsible for any third-party property damage or liability unless covered by your own insurance.

12. Liability and Theft

12.1 You are liable for any loss or damage to the E-Bike, Scooter, or Motorcycle, including theft, but you are covered by Nibble Bikes’ insurance for the E-Bike, Scooter, or Motorcycle itself, subject to the applicable Excess Fee.

12.2 You must not leave the E-Bike, Scooter, or Motorcycle unattended post-accident or breakdown without securing it.

12.3 Failure to secure the E-Bike, Scooter, or Motorcycle post-accident or breakdown may result in an Excess Fee (clauses 9.1, 9.2, 12.7) if the E-Bike, Scooter, or Motorcycle is stolen.

12.4 Nibble Bikes provides compulsory third-party insurance (CTP) as required by law, which covers personal injury to third parties (see clause 11.1 for third-party property damage and other liabilities).

12.5 Nibble Bikes’ insurance covers damage to the rented E-Bike, Scooter, or Motorcycle itself, subject to the Excess Fee (clauses 9.1, 9.2), unless the damage results from a Major Breach.

12.6 You must take reasonable steps to secure the E-Bike, Scooter, or Motorcycle at all times to prevent theft or damage, including ensuring it is locked and keys are kept in your or an Authorised Rider’s possession.

12.7 If the E-Bike, Scooter, or Motorcycle is stolen, including due to being left unattended post-accident or breakdown, an Excess Fee applies as outlined in the Fee Chart (clauses 9.1, 9.2).

13. Termination

13.1 The subscription is indefinite and ends when you return the E-Bike, Scooter, or Motorcycle to Nibble Bikes. You may terminate the Rental Contract without written notice by returning the vehicle. If Nibble Bikes decides to terminate the Rental Contract, we will provide written notice, and you must return the E-Bike, Scooter, or Motorcycle within 24 hours of receiving such notice.

13.2 Nibble Bikes may terminate the agreement immediately if you commit a Major Breach, with applicable fees charged.

13.3 If you fail to return the E-Bike, Scooter, or Motorcycle and its location is known, we may recover it by lawful means. If the location is unknown, after reasonable attempts to contact you, we will report the E-Bike, Scooter, or Motorcycle as stolen to the police.

14. Toll Charges

14.1 The Scooter or Motorcycle is registered with Linkt for toll roads. Toll charges will be deducted from your card on file or provided bank account, whichever is relevant, within a reasonable time after Nibble Bikes receives a toll notice, prior to refunding the Security Deposit.

14.2 A breach of clause 14.1 constitutes a Major Breach of the Rental Contract.

15. Major Breach

15.1 A Major Breach includes, but is not limited to, breaches of clauses 2, 4, 5.7, 5.9, 8.2, 9.4, or 14, or if the E-Bike, Scooter, or Motorcycle is stolen by you or an Authorised Rider or by any person acting for you, and may result in immediate termination of the Rental Contract, additional fees, or full liability for damages.

15.2 In case of a Major Breach, you remain liable for all fees and damages as per the Fee Chart.

16. General

16.1 These terms are governed by the laws of the jurisdiction in which the rental occurs (e.g., Queensland for Brisbane rentals). The Australian Consumer Law provides you with rights that are not affected by the Rental Contract.

16.2 Nibble Bikes reserves the right to amend these terms by providing 30 days’ notice in writing, as per clause 1.5.

16.3 Nibble Bikes is not responsible for economic or consequential loss due to E-Bike, Scooter, or Motorcycle breakdown, subject to Australian Consumer Law.

17. Privacy

17.1 Nibble Bikes collects personal information (e.g., name, contact details, payment information, and driver’s license) to process your rental and comply with legal obligations. When you sign the Rental Agreement:

17.2 Your information may be shared with third parties (e.g., Linkt for tolls) only as necessary for the rental service.

17.3 Nibble Bikes complies with Australian privacy laws. You may request access to your personal information by contacting Nibble Bikes.

18. Cancellation

18.1 There are no cancellation fees if you change your mind prior to the Start of the Rental. However, if you return the E-Bike, Scooter, or Motorcycle before the minimum two-week rental period, you will be charged the full Rental Charges for the two-week period.

18.2 The rental is cancelled upon return of the E-Bike, Scooter, or Motorcycle to the Rental Location.

18.3 If you return the E-Bike, Scooter, or Motorcycle after the minimum two-week rental period during standard business hours, you will be refunded on a pro-rated basis for any unused days, provided all other conditions of the Rental Contract are met.

19. Dispute Resolution

19.1 Any disputes arising from the Rental Contract should first be addressed by contacting Nibble Bikes’ customer service.

19.2 If the dispute remains unresolved, it may be referred to mediation or resolved under the laws of the jurisdiction governing the rental (clause 16.1).

Definitions

Accident: An unintended and unforeseen incident, including:

Authorised Rider: A person approved by Nibble Bikes to operate the E-Bike, Scooter, or Motorcycle, as noted in the Rental Agreement.

Damage: Any damage to the E-Bike, Scooter, or Motorcycle, including its parts, components, and accessories, that is not fair wear and tear; and Loss of Use. Damage to lights, mirrors, seats, or tyres that makes the vehicle unroadworthy is not fair wear and tear. Third-party towing or storage costs are not included in Damage and are your separate responsibility.

Damage Excess: The amount, including GST, up to which you must pay Nibble Bikes in the event of an Accident or theft, including theft due to an unattended vehicle post-accident/breakdown, as per the Fee Chart (clauses 9.1, 9.2, 12.7).

Direct Debit Service Agreement: The section of these Terms and Conditions (clauses 5.7, 5.8, 5.10, 5.11, 14.1) that authorizes Nibble Bikes to automatically debit Rental Charges and other fees from your card on file or provided bank account, whichever is relevant.

E-Bike, Scooter, or Motorcycle: The E-Bike, Scooter, or Motorcycle described in the Rental Agreement, including its parts, components, tools, and accessories, including the helmet where rented.

End of the Rental: The date and time when the E-Bike, Scooter, or Motorcycle is returned to Nibble Bikes, ending the indefinite subscription.

Handover Inspection Report: The report, including photos, provided alongside these Terms and Conditions at the Start of the Rental, which documents the condition of the E-Bike, Scooter, or Motorcycle and lists any Damage at the time of inspection.

Loss of Use: Nibble Bikes’ loss, calculated on a daily basis at the daily rate shown in the Rental Agreement, because the E-Bike, Scooter, or Motorcycle is being repaired or replaced if written off as a result of an Accident or theft.

Major Breach: A breach as defined in clause 15.1.

Off Road: Any area that is not a sealed or unsealed road, including unformed roads, fire trails, tracks, river and tidal crossings, creek beds, beaches, streams, dams, rivers, floodwaters, sand, deserts, rocks, fields, and paddocks.

Rental Charges: The charges payable for renting the E-Bike, Scooter, or Motorcycle, together with GST and any other taxes or levies, as set out in the Rental Agreement.

Rental Location/Rental Station: The Nibble Bikes showroom or designated pick-up location from which you rented the E-Bike, Scooter, or Motorcycle.

Rental Period: The period commencing at the time shown in the Rental Agreement and concluding at the End of the Rental when the E-Bike, Scooter, or Motorcycle is returned.

Security Deposit: A refundable amount based on the customer’s selected plan (Shield, Glide, or Boost), as outlined in the Fee Chart (clause 5.4).

Start of the Rental: The date and time that the rental commences as shown in the Rental Agreement.

Third Party: Any person, entity, vehicle, or property, other than you (the rider) or Nibble Bikes, that is affected by or involved in an incident during the Rental Period, including but not limited to accidents or claims involving property damage or personal injury.

Unsealed Road: A road, other than one undergoing temporary roadworks, that has been formed and constructed but is not sealed with a hard material such as tar, bitumen, or concrete.

We/Us/Our/Nibble Bikes: Nibble Holdings Pty Ltd ABN 63613493244.

You/Your: The person, whether an individual, firm, or company, that rents the E-Bike, Scooter, or Motorcycle from Nibble Bikes, as shown in the Rental Agreement.
